Texas Fathers’ Rights: The Legal Framework

Texas family law uses the term conservatorship rather than custody. Understanding the structure helps fathers know what they’re working toward and what’s realistically available under the law.

Joint Managing vs. Sole Managing Conservatorship

Texas courts recognize two primary conservatorship frameworks. Joint managing conservatorship (JMC) is the default preference under state law. It allows both parents to share decision-making authority over significant matters like education, healthcare, and extracurricular activities, though the court typically designates one parent to determine the child’s primary residence. Sole managing conservatorship (SMC) grants one parent broader independent authority and is generally reserved for situations involving family violence, abuse or neglect, or circumstances where requiring cooperation between the parents would be harmful or unworkable.

Geographic Restrictions & the Possession Schedule

When a court designates which parent determines the primary residence, it commonly imposes a geographic restriction limiting the child’s primary residence to a specific county and those surrounding it. This restriction protects the other parent’s possession and access schedule by preventing unilateral relocation. If the custodial parent wants to move the child outside that zone, they must either get the other parent’s written agreement or return to court for approval.

The Best-Interests Standard

All conservatorship and possession decisions in Texas are governed by the best-interests-of-the-child standard. The Texas Family Code doesn’t favor either parent based on gender. Courts weigh factors including the child’s physical and emotional needs, each parent’s involvement and stability, and any history of family violence or substance abuse.

Paternity for Unmarried Fathers

An unmarried father has no enforceable parental rights until legal paternity is established. Texas law provides several paths: a voluntary Acknowledgment of Paternity signed by both parents; a court order following DNA testing; or a statutory presumption under the Texas Family Code. Presumptions arise in several distinct situations, including being married to the mother when the child is born or, for an unmarried man, continuously residing in the same household as the child during the first two years of the child’s life and representing to others that the child is his own. Once paternity is established, a father can pursue conservatorship, a possession and access schedule, and other rights through a Suit Affecting the Parent-Child Relationship (SAPCR).

Modification & Enforcement

An existing conservatorship or possession order isn’t necessarily permanent. A material and substantial change in circumstances, such as a job change, relocation, or a safety concern, can justify filing a modification suit. If the other parent is violating an existing order, enforcement through the courts is available, including contempt proceedings and make-up possession time.
