How Texas Courts Calculate Child Support

The Texas Family Code establishes a presumptive child support amount based on the non-custodial parent’s “net resources”. This figure isn’t the same as take-home pay. Net resources start with total income (wages, commissions, bonuses, and overtime) and subtract allowable deductions such as taxes and the child’s health insurance premiums. Once monthly net resources are established, the court applies a percentage based on the number of children being supported. We scrutinize every financial detail to establish an accurate income baseline and advocate for a support amount that complies with the Texas Family Code.

The guidelines serve as a starting point, not an absolute rule. A judge may deviate from the standard percentage if the evidence shows the guideline amount would be “unjust or inappropriate.”
