Military Retired Pay & the 10/10 Rule

The Uniformed Services Former Spouses’ Protection Act permits state courts to treat disposable military retired pay as property subject to division under applicable state law. It doesn’t automatically give a former spouse a share. Any division depends on Texas law, the facts of the marriage, and the court’s orders.

An order dividing retired pay must describe the benefit and payment terms precisely enough for enforcement. The 10/10 rule generally determines whether the Defense Finance and Accounting Service (DFAS) can make direct payments for a retired-pay property award. This mechanism may be available when the marriage and creditable service overlapped for at least 10 years.

The rule doesn’t determine whether every property division award is valid. It also doesn’t govern DFAS enforcement of child support or alimony in the same way.

Military Retirement Benefits Beyond Retired Pay

The Thrift Savings Plan and other service-related accounts may require classification, valuation, and division based on the facts. Survivor Benefit Plan elections and former-spouse protections may require specific language in the divorce documents, along with action after the decree.

The 20/20/20 rule concerns potential continued eligibility for certain former-spouse benefits. It generally requires at least 20 years of marriage, 20 years of creditable service, and 20 years of overlap. Meeting those measurements doesn’t make every benefit automatic, so eligibility must be evaluated under the applicable rules.

Deployment, Custody & Support Decisions

The Servicemembers Civil Relief Act provides certain protections when military duties materially affect a service member’s ability to participate in a civil case, including a child-custody proceeding. A qualifying service member may request a stay, or temporary pause, when the statutory conditions are met. Whether the court grants one depends on the facts and supporting documentation.

Deployment or a permanent change of station may require temporary orders and parenting plans that address notice, parent-child communication, travel, and care during an absence. The effect of military orders on custody, deadlines, and court participation depends on the circumstances and existing orders.

Child support and spousal-support calculations may require detailed compensation records. An accurate analysis depends on identifying which forms of pay Texas law treats as relevant.

Texas Divorce Residency for Military Families

Texas generally requires a spouse to satisfy state and county residency requirements before filing for divorce. Under Texas Family Code Sections 6.303 and 6.304, military service, time spent outside Texas or a county, and stationing at a Texas military installation can affect domicile and residency.

The correct filing location depends on the parties’ residence, domicile, military status, and the facts supporting the court’s jurisdiction. Service members and spouses in Frisco should evaluate these questions before filing, particularly if either party has moved or received reassignment orders.
