When Is a Divorce Uncontested?

A divorce qualifies as uncontested when you and your spouse agree on every single issue required to legally end the marriage. In these cases, you do not ask a judge to make decisions for you. Instead, you present a fully formed agreement to the court for approval.

Many clients initially believe their case is uncontested because they agree on the decision to divorce. However, true uncontested status depends on total consensus regarding the details. If even one issue remains unresolved, such as who keeps a specific vehicle or how to handle holiday visitation, the court considers the case contested until you resolve that dispute.

To proceed with an uncontested divorce in Texas, you and your spouse must reach a mutual understanding on several key matters:

  • Child custody. You must decide how to share rights and duties regarding your children. This includes designating which parent has the exclusive right to determine the primary residence of your children and how you will make educational, medical, and psychological decisions.
  • Visitation schedules. You need a clear schedule for when each parent will have your children. While Texas law does provide a default schedule called the “standard possession order,” you may agree on a custom schedule that better fits your family’s routine, provided it serves the best interests of your children.
  • Child support. You must agree on the amount of financial support one parent will pay to the other to assist with your children’s living expenses.
  • Division of community property. You must categorize and divide all assets acquired during the marriage (with some exceptions). This includes real estate, retirement accounts, vehicles, bank accounts, and household goods. You need to distinguish between community property (owned jointly) and separate property (owned individually before marriage or acquired by gift or inheritance).
  • Allocation of debts. You must assign responsibility for all liabilities, including mortgages, credit card balances, car loans, and student loans. Texas law requires a "just and right" division, but you have the flexibility to decide what that looks like for your specific financial situation.
  • Spousal maintenance. If one spouse requests financial support (also referred to as spousal support or alimony) after the divorce, you must agree on the amount and duration of these payments. If you do not agree on this, the court will likely have to intervene.
