How Do Texas Courts Calculate Child Support?

Texas law aims to provide a fair standard for child support obligations, but the calculation process involves more than simply plugging numbers into a formula. Understanding the nuances of how the courts determine these figures allows us to approach your case with realistic expectations and a strong, practical strategy.

The Texas Family Code establishes a "presumptive" amount of child support based on the non-custodial parent's "net resources." This figure is not the same as take-home pay. We can calculate net resources by taking total income, including wages, commissions, bonuses, and overtime, and subtracting specific allowable deductions like taxes and the cost of the child's health insurance. Once we establish the monthly net resources, the court applies a percentage based on the number of children being supported.

While the guidelines serve as a starting point, they are not absolute. A judge may deviate from the standard percentage if the evidence shows that the guideline amount is "unjust or inappropriate."
